1. What is personal data?

The term ‘personal data’ covers any information relating to an identified or identifiable natural person.

An ‘identifiable natural person’ is one who can be identified, directly or indirectly, in particular by reference to an identifier, such as a name, an identification number, location data, an online identifier, or to one or more factors specific to his or her physical, physiological, genetic, mental, economic, cultural or social identity;

2. Why does ILRES S.A. process the personal data of MyPanel Members?

ILRES S.A. is a market and opinion research company. Its activity leads it to carry out multi-theme surveys.

Some of these surveys are carried out with voluntary participants, known as MyPanel Members. These are people who have agreed to ILRES S.A. regularly inviting them to take part in the surveys it carries out via online questionnaires.

When you wish to become a MyPanel Member, ILRES S.A. asks you to register by filling in a form online, which includes general information about you, such as your municipality of residence, your date of birth and the number of people in your household.

Once you have registered, you will be regularly invited to answer online questionnaires.

Each questionnaire completed in full entitles you to a reward, the amount of which in euros varies according to the number of questions asked. At any time, you can ask for your rewards to be paid into the bank account of your choice, your own, that of a third party, or even that of a charity.

3. What authorizes ILRES S.A. to process MyPanel Members’ data?

The processing of MyPanel Members' personal data is based on their consent. Becoming a MyPanel Member is voluntary, and you may remove yourself from this panel list at any time. Similarly, although ILRES S.A. relies on the cooperation of each of its MyPanel Members, none of them is ever obligated to participate in the survey for which they are requested, or even to answer all of the questions asked in a survey.<''>Nevertheless, it goes without saying that certain information is essential to maintaining the relationship that each MyPanel Member has with ILRES S.A. ILRES S.A. cannot invite its MyPanel Members to respond to its surveys without using their email address, and it needs to know the bank details of the person to whom it must pay their rewards, whether it is themselves or a third party.

4. Who is responsible for processing the personal data of MyPanel Members?

ILRES S.A.'s client may be jointly responsible for the processing of data collected through the survey. ILRES S.A. may also be the sole data processor. The identity of this joint controller or the controller for which ILRES S.A. is the processor will be communicated to the survey participant whenever possible, either before participation or sometimes at the end of the questionnaire when it is necessary to conceal the identity in question to avoid influencing the participant's responses. In exceptional cases, the identity of the joint controller or the controller for which ILRES S.A. is the processor must remain confidential, in which case ILRES S.A. will explain the reasons for this confidentiality in the email inviting participants to participate in the questionnaire.

In any event, participants may always contact ILRES S.A. to obtain information regarding data processing and to exercise their rights.

5. How is MyPanel Members' personal data used and what happens to it?

ILRES S.A. collects the information provided by its MyPanel Members through the questionnaires they complete in order to conduct surveys and polls related to economic, political, and social affairs, as well as market research. It combines and analyzes this information to produce reports that it publishes or provides to its clients in statistical form.

ILRES S.A. also invites its MyPanel Members to participate in surveys conducted by its business partners, in which case, these partners collect the information provided through the questionnaire. However, these partners do not have access to the contact information of MyPanel Members. ILRES S.A. also verifies that the content of survey questionnaires from these partners does not allow them to identify MyPanel Members, and it has taken contractual measures to prohibit such identification.

Reports published or provided to clients do not allow participants to be identified. MyPanel Members' personal data is treated confidentially and stored securely.

6. What happens to MyPanel Members' personal data and how long is it kept?

ILRES S.A. retains the information allowing it to contact MyPanel Members and pay their rewards for as long as they remain members of the panel.

It retains for the same period the data necessary to create panel profiles, i.e., demographic characteristics such as date of birth, gender, nationality, municipality of residence, or income category. This information is necessary when the survey it conducts concerns only a targeted audience, which can be selected based on these demographic characteristics. Thanks to these demographic profiles, ILRES S.A. can avoid unnecessarily soliciting MyPanel Members who are not relevant to the current survey. For example, to avoid contacting men when the goal is to gather only the opinions of women, or residents of the north of the country when the goal is to gather the opinions of southern residents.

MyPanel Members can view the list of demographic information ILRES S.A. has about them by logging in to the account assigned to them upon registration.

Other information and opinions that MyPanel Members share with ILRES S.A. or one of its business partners during surveys, i.e., information that does not constitute demographic characteristics or data necessary to contact or pay its panelists, are anonymized as soon as possible, depending on the survey, and in particular the duration of the survey. ILRES S.A. will retain this personal data for a period of 3 to 6 months in order to respond to customer requests to verify the validity of the survey.

When a MyPanel Member indicates their intention to withdraw from the list of panelists, ILRES S.A. will retain the number of the bank account on which they requested payment of their rewards, the first and last name, or the business name of the holder of this account, as well as their address, for a period of ten years starting on January 1 following the date of the last reward payment made. ILRES S.A. must retain this information in order to fulfill its obligation to retain accounting documents provided for by the French Commercial Code. It will then no longer use this information for any other purposes.

ILRES S.A. will delete other information concerning the person wishing to withdraw from the MyPanel Members no later than one month after receipt of the withdrawal decision or request for erasure of data, except for the information necessary to prove that it has actually processed this request. This information will be kept for the sole purpose of proof during the legal limitation period applicable to any administrative procedures or civil and criminal actions against it in relation to this processing, as well as, where applicable, until the pronouncement of all final and definitive decisions following the introduction of such procedures or actions.

7.Where and how is the personal data of MyPanel Members stored?

ILRES S.A. takes every precaution to maintain the security of the information it processes. To this end, it has implemented all necessary measures to secure its IT systems. Personal data is stored on secure servers located within the European Union and is only accessible to a limited number of its employees.

8. Does ILRES S.A. share the personal data of MyPanel Members with other people?

Some ILRES S.A. service providers have access to certain data concerning its panelists, such as banks for the payment of rewards, or the cloud service provider for data storage.

In order to process the payment of its panelists' rewards, ILRES S.A. transfers to its Luxembourg banking institution the bank account number from which the panelists requested this payment, the first and last name or business name of the account holder, and their address. This information is also transferred by ILRES S.A. to its accountant.

From the time they are collected until their analysis, the data and information obtained through surveys are stored via a private cloud system. The cloud service provider used by ILRES S.A. stores this information on secure servers located within the European Union.

All these service providers only have access to the information essential to the performance of the task entrusted to them by ILRES S.A. The latter contractually ensures that they comply with all required security measures regarding this information and that they do not use it for purposes other than performing the task entrusted to them by ILRES S.A.

ILRES S.A. communicates the data and information obtained during online surveys to its client in an aggregated manner, without the latter being able to identify the participants.

When it offers its MyPanel Members the opportunity to participate in a survey from one of its business partners, ILRES S.A. provides that partner with a list of temporary codes created specifically for each survey. These codes are necessary for ILRES S.A. to identify the panelists who have completed the survey and are therefore entitled to the reward. Each of these codes corresponds to one of the MyPanel Members invited to participate in the business partner's survey. However, to keep the identity of its panelists confidential, ILRES S.A. does not disclose to the partner to whom it assigned the codes in question.

No other personal data concerning MyPanel Members is transferred by ILRES S.A. to anyone, unless such disclosure is required by law.

9. What are the rights of MyPanel Members regarding their personal data?

If you are a MyPanel Member, you have the following rights regarding your personal data processed by ILRES S.A.:

  • Right of access: You have the right to request that ILRES S.A. provide you with information regarding the personal data it holds about you. The list of this information is accessible by logging into the account assigned to you upon registration.
  • Right of rectification and erasure: You have the right to request that ILRES S.A. rectify any personal data it holds that is found to be inaccurate. You may also request that ILRES S.A. erase your personal data. This request may, however, result in your removal from the MyPanel Members list, while maintaining your presence on this list requires the use of your contact and demographic information. Furthermore, ILRES S.A. will retain your data to the extent required to comply with its legal obligations, including the ten-year retention period for its accounting records, or when the retention of this data is necessary to exercise or defend its legal rights.
  • Right to restriction of processing: You have the right to ask ILRES S.A. to suspend the processing of your personal data while a verification can take place (for example, to verify the accuracy of the personal data processed).
  • Right to portability: You have the right to request ILRES S.A. to transmit the data it holds about you directly to another data controller, provided that such transfer is technically feasible.
  • Right to withdraw consent: You have the right to withdraw your consent at any time for the processing of the information you provided by participating in a survey.
    You also have the right to withdraw your consent at any time for ILRES S.A. to process the information you provided by becoming a MyPanel Member, i.e., your contact details and demographic data. This request, however, will result in your removal from the MyPanel Member list, while maintaining your membership on this list requires the use of your contact details and demographic information. Furthermore, ILRES S.A. will retain your data to the extent required to comply with its legal obligations, including the ten-year retention period for its accounting records, or when the retention of this data is necessary to exercise or defend its legal rights.
  • Right to object: You have the right to object to the processing of your personal data by ILRES S.A.
  • Right to lodge a complaint with the supervisory authority: If you believe that ILRES S.A. does not respect your rights regarding the processing of your personal data, you may lodge a complaint with a supervisory authority. For the Grand Duchy of Luxembourg, this supervisory authority is the National Commission for Data Protection. (https://cnpd.public.lu)

10. How can you exercise these rights?

You can exercise your rights regarding your personal data by writing to ILRES S.A., 41, rue du puits Romain L-8070 Bertrange, or by email at the address DPO@ilres.com

Please note, however, that ILRES S.A. will anonymize the personal data collected during surveys as soon as possible, sometimes within a shorter timeframe than the 3 to 6 months stated in point 6 above. It is therefore possible that your data has already been anonymized by the time you submit your request.

A response will then be sent to you as soon as possible and, unless ILRES S.A. informs you of any special circumstances, no later than one month following receipt of your request.

11. Cookies.

The questionnaires we invite you to participate in will generally be administered from the Nfield online platform, requiring the use of the "_Request Verification Token" and "ASP .NET Session Id" cookies. These cookies do not allow us to collect any personal data about you.

This is a cookie necessary for the protection of the information collected through the questionnaire, and will be destroyed when the browser is closed.
